     The S Zone Ordinance adopted on May 4, 1954 contains a series of conditions that must be satisfied for the two lots
          to remain in the B-2 District, and places full jurisdiction over changes to plans affecting these lots within the approval
          authority of the Common Council. Furthermore, the S Zone Ordinance imposes the following additional controls:
              1. The use of the two lots (13 and 14) is limited to “‘off-street’ parking of vehicles in conjunction with the adjacent
                   business premises, to wit lots 7, 8, 9, 10, 11, and 12, block 63 ward 6.â€� The business use on lots 7 through 12 at
                   the time the S Zone Ordinance was adopted was the former Milk Maid Store. These lots are now part of Section
                   Block Lot 138.14-8-1. Until recently the business use on lots 7 through 14 was the Sports Page restaurant.
               2. The S Zone Ordinance requires that all lots (7 through 14) remain in common ownership. As stated above, they
                    have now been consolidated into a single, common ownership lot, Section Block Lot 138.14-8-1.
               3. Lots 13 and 14 are required to have a 25 foot landscaped area along Dale Street and a 10 foot landscaped area
                   along the rear portion of the two lots, which landscaped areas must be maintained.
               4. The parking area permitted on lots 13 and 14 is required to be “suitably paved, drained, fenced, lighted and screened
                    by landscaping,â€� the plans for which are subject to approval by the Common Council.
               5. Final plans, including plot plans ands specifications for any buildings to be erected on said lots 7, 8, 9, 10, 11,
                   and 12 are also subject to the approval of the Common Council.

 The owner of the property has been soliciting potential tenants since October 2006.  The owner has very
specific stipulations in the lease for a new tenant.  First, they would prefer a dry retail type of
establishment.  Second, the new tenant would need to redevelop the site within the special zoning
ordinance and completely renovate or rebuild the structure on the site.  There has been interest from bars,
restaurants, specialty food stores, and markets.  The owner has not yet located a tenant that would fit the
neighborhood and be willing to take on the necessary work to redevelop the site.
